NOTICE BY PUBLICATION
A Complaint for Custody and Special Immigrant Juvenile Status was filed with the Circuit Court for Montgomery County on March 17, 2025. The Complaint alleges in substance: 1) Plaintiff is the biological mother of Ivania Yamileth Munguia Arias, female, born on January 26, 2005, in Guatemala ("Minor Child"); 2) Heman Antonio Munguia Alarcon is the biological father of the Minor Child ("Defendant"); 3) The Defendant abandoned the Plaintiff and Minor Child in Guatemala on or about July 2010 at which time he returned to El Salvador, his country of nationality; 4) Since July 2010 the father has not provided any financial support for the Minor Child and has not had any contact with the Minor Child; 5) Since the Minor Child has been in the US, the father has not attempted to contact the Minor Child nor the Plaintiff; 6) That the Defendant is not a fit and proper parent and reunification between Defendant and the Minor Child is not viable due to abandonment and neglect; 7) That it is in the Minor Child's best interests to reside in the United States with the Plaintiff; 8) Plaintiff seeks sole legal and physical custody of the Minor Child and also seeks factual findings that would enable the Minor Child to apply for Special Immigrant Juvenile Status.
It is this 14th day of April, 2025, ORDERED, that the Plaintiff cause a copy of this Notice to be published at least once a week for three consecutive weeks in a newspaper of general and national circulation published in El Salvador; publication to be completed by May 17, 2025: Defendant must file a response on or before June 26, 2025 Defendant is warned that failure to file a response within the time allowed may result in a default judgment or the granting of the relief sought.
